The two Student Government Association (SGA) vice presidents who faced the Office of Student Conduct and Conflict Resolution (OSCCR) this past week on implications of underage drinking were found not responsible, according to a statement from the SGA.
The decisions were disclosed to Erin McFazden, vice president for student affairs, and Bill Durkin, vice president for academic affairs, Tuesday afternoon.
“The organization as a whole is thrilled that both vice presidents are OK,” said SGA President Andres Vargas.
A report filed by Orientation Leader (OL) supervisor Marc Lo accused nine OLs, McFazden, Durkin and others of drinking while attending an alleged party at Vargas’ Mission Hill residence Aug. 14. The OLs also faced OSCCR last week for implications of underage drinking.
Lo, who resigned as an OL supervisor after filing the report for allegedly breaching his contract when he fraternized with an OL, said he feels Durkin and McFazden “absolutely” should have received probation because the Student Code of Conduct applies to all students, including SGA executive board members.
“That’s why we have a Student Code of Conduct. It’s not a set of rules or regulations that fluctuates depending on the person. It’s something that every student, regardless of their leadership status, should be held to,” Lo said.
Former OLs Nina Baltierra, Olivia Kim and Joanna Simon all said they admitted responsibility and received punishment for their actions.
A $50 fine, an online alcohol course and probation were handed down to Simon who said she is relieved her situation, as well as Durkin and McFazden’s, are over with.
“I’m really comforted to know that our school would actually look into a case like that before making judgments on them. I’m relieved at the outcome of their situation,” she said. “My situation is over and done with. Right now I feel like what went on with the Orientation Leaders is over and we’re moving on from that.”
Like Simon, Kim said she is pleased to hear of the outcome for the SGA e-board members.
“I’m very, very glad they get to stay in office,” Kim said. “I feel that they’re excellent student leaders and they deserve to hold the position that they were appointed for this year.”
Former SGA Vice President for Financial Affairs Michael Benson said he feels the decisions handed down from OSCCR for both the OLs and SGA e-board members were fitting.
“As far as I know, the two SGA vice presidents weren’t drinking. The OLs apparently were, and as such, they received the appropriate sanctions from the Student Code of Conduct,” Benson said.
Vargas is waiting for his appearance before the student judicial board next week. Until a decision is made concerning Vargas’ role in the party, Benson said the SGA president should not be treated differently.
“President Vargas will be the president until such time as his term of office expires, he is im-peached or he resigns. To my knowledge, none of these things have occurred and as such I feel that he deserves our respect,” Benson said.
Statements from Durkin and McFazden will be given Thursday during SGA’s first senate meeting of the fall semester, Vargas said.
