Don Brown will see action on the field rather than in court this season due to a recent ruling and a possible settlement which his attorney, A. Bernard Guekguezian, is in the process of coordinating with Northeastern.
After a judge overturned a decision barring the former Husky football coach from heading the University of Massachusetts football team April 8, the schools and Brown are working towards a monetary settlement, said Christine Phelan, the assistant director of communications and public relations at Northeastern.
“We are pleased that the litigation was settled in a way that upholds the integrity of the signed contract and supports the ethical values we teach to our students,” Phelan said.
On Feb. 9, Brown accepted the position at UMass, breaching a contract with Northeastern to remain as the head coach until 2008, while the school was drafting another extension to keep the coach until June 2009. UMass was denied its request for permission to speak with Brown by Northeastern Athletics Director David O’Brien, yet pursued the coach anyway, O’Brien said.
The schools went to court, and on March 11, Suffolk Superior Court Judge Thomas E. Connolly ruled in favor of Northeastern and granted a preliminary injunction disallowing Brown’s affiliation with UMass, which was recently overturned.
Phelan declined to comment on a dollar amount, but said the settlement process is currently taking place. O’Brien, as well as the lawyers for both schools, declined to comment until details are finalized.
